Mental Health at Work: Companies Get More Time to Comply with New Legal Requirements

The Ministry of Labor and Employment (MTE) has extended the deadline to May 25, 2026, for the enforcement of requirements that recognize psychosocial factors — such as moral and sexual harassment — as occupational risks.

As a result, companies now have more time to update their Risk Management Programs (PGR), including measures focused on workers’ mental health and well-being.

The new requirements stem from the 2024 amendment to Regulatory Standard No. 1 (NR-1), which now mandates the inclusion of psychosocial risks in the PGR, alongside physical, chemical, biological, ergonomic, and accident-related risks. This change reflects growing concern over the rise in mental health disorders and the need for healthier work environments.

One aspect already evident to many companies is that there is no one-size-fits-all formula for mapping psychosocial factors. Each organization must, with the support of its Occupational Health and Safety professionals, consultants, and HR teams, define the most appropriate strategy for its reality, considering its size, sector, and business model.

Despite the postponement, this is a timely opportunity for companies to begin or deepen their analysis of the psychosocial factors present in their environments. Those that use this time to prepare will be better positioned to comply with the regulation and, above all, to promote a healthier and more productive work environment.
